Please see the attached document entitled City of Sunnyvale LRS Theater Lighting Surplus Property for an itemized list that includes more detailed information such as brand, model fixture type, serial no. and condition. PLEASE NOTE: while the condition of the fixtures is noted, this information came from the end users who last used these items in approx. the second half of 2024. They have not been used and/or tested since. While the pictures included may not capture every fixture, they do reflect what the fixtures look like and how they are currently staged.
The itemized list shows approximate quantities; actual numbers may vary slightly. While the City has done its best to ensure accuracy, it’s not guaranteed to be 100% precise. The buyer understands and agrees that said property is offered “as is and where is” by the City, and that the City makes no guarantee or warranty whatsoever as to its condition or usefulness.
NO Inspections on Site. The buyer is responsible for all aspects of pick-up / removal, including but not limited to packing, loading, transportation and exporting. Note: Shipping is NOT available.

The buyer is responsible for all aspects of pick-up / removal, including but not limited to packing, loading, transportation and exporting. Note: Shipping is NOT available.
Removal is by appointment only. All items must be picked-up / removed within 10 (ten) business days from auction closure, unless otherwise stated in the asset description. If any item(s) is not removed within the allotted timeframe, the item(s) may be declared abandoned.
At the time of pick-up / removal, you will be required to present the seller with a copy of your Buyer’s Certificate and/or bill of sale, and potentially other documentation (e.g., copy of driver's license, Authorization of Release, etc). When making a removal appointment, please confirm with the seller what is needed to release the item(s).

NOTICE: If you are the winning bidder and default by failing to adhere to this seller's terms and conditions, your account with Liquidity Services WILL BE LOCKED.
Guaranty Waiver: The buyer agrees to remove said property safely from City property at a time and date to be arranged. The buyer understands and agrees that said property is offered “as is and where is” by the City, and that the City makes no guarantee or warranty whatsoever as to its condition or usefulness. The buyer agrees to indemnify and hold harmless the City, its officers, officials, directors, employees, and agents from and against any and all loss, liability, expense, claim, costs, suits, and damages of every kind, nature, and description directly or indirectly arising from the buyer’s purchase of this equipment. Please note that upon removal of the property, all sales are final.
Description Warranty. Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property.
Diesel Trucks & Buses:
An on-road heavy-duty diesel or alternative-diesel vehicle operated in California may be subject to the California Air Resources Board Regulation to Reduce Particulate Matter and Criteria Pollutant Emissions from In-Use Heavy-Duty Diesel Vehicles. It, therefore, could be subject to exhaust retrofit or accelerated turnover requirements to reduce emissions of air pollutants. All Passenger Vehicles:
This agency does NOT provide SMOG CERTIFICATION or EMISSIONS RETROFIT. All smog related repairs and certifications for vehicles are the sole responsibility of the buyer as outlined in California Vehicle Code, Division 12, Section 24007.5.
Heavy Equipment:
TITLE 13 CALIFORNIA CODE DISCLOSURE OF REGULATION APPLICABILITY: WHEN OPERATED IN CALIFORNIA ANY OFF-ROAD DIESEL VEHICLE MAY BE SUBJECT TO THE CALIFORNIA AIR RESOURCES BOARD IN-USE OFF-ROAD DIESEL VEHICLE REGULATION. IT THEREFORE COULD BE SUBJECT TO RETROFIT OR ACCELERATED TURNOVER REQUIREMENTS TO REDUCE EMISSIONS OF AIR POLLUTANTS.
