Online Sales - Terms and Conditions
All bidders and other participants of this service agree they have read and fully understand these terms and agree to be bound thereby.
LIABILITY: All items are sold “as is” and “where is” without warranty either expressed or implied (meaning the condition and the location is final and you are offering to purchase the item based on its current condition and location). No warranties are offered. If you are unclear about any condition of this Sale, you should contact the Purchasing Division for clarification at 248-871-2430. All sales will be final. The City may withdraw an item at any time from the auction. The City of Farmington Hills assumes no liability for inaccurate or erroneous descriptions contained in any descriptive material pertaining to the auctioned equipment.
Personal and property risk. Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the seller and GovDeals from liability therefore.
INSPECTION OF VEHICLES: It is strongly recommended that all interested parties inspect each item thoroughly before an offer to purchase is submitted. Major or minor defects may or may not be noted. Other defects may exist and it is your responsibility to verify the functional ability of each item listed. Vehicle may be inspected by contacting Farmington Hills Fire Dept. Apparatus Coordinator Jason Gilbert, 31455 W. Eleven Mile Rd., Farmington Hills, MI. 48336, (Direct) 248-871-2825.
Consideration of Bid. Seller reserves the right to reject any and all bids and to withdraw from sale any of the assets listed.
Buyer’s Certificate. Successful bidders will receive a Buyer’s Certificate by email from GovDeals.
PAYMENT: All vehicles purchased must be paid in full prior to pick-up. The City of Farmington Hills Treasurer accepts cash, money orders, certified or cashier’s checks and personal checks with a valid picture I.D. The City of Farmington Hills retains the right to hold all personal checks up to 15 business days to insure bank clearance. Payment will be made at The City of Farmington Hills Treasurer’s Office which is located at 31555 West 11 Mile road, Farmington Hills, MI 48336. Applicable State sales tax will be charged from the Secretary of State when title is transferred.
Additional Fees: A 7.5% Administrative Fee will be added to the final sales price.
PICK-UP: Once a vehicle has been paid for, vehicles can be picked up by the awarded bidder at the City of Farmington Hills Fire Dept., 31455 W. Eleven Mile Rd., Farmington Hills, MI, 48336. The awarded bidder must bring the title or a letter authorizing pick-up from the awarded bidder to the Fire Department in order to pick up any vehicles. All vehicles will be removed at the risk and expense of the purchaser. The items must be loaded without City staff participation.
PICK-UP TIME LIMIT: If the vehicles are not picked up within 10 business days after the auction expiration date and time, the City of Farmington Hills reserves the right to retain the vehicle and re-list it for auction and block the bidder from future auctions.
Vehicle Titles. Seller will issue a title or certificate upon receipt of payment. Titles may be subject to restrictions as indicated in the asset description on the website.
ADDITIONAL TITLE INFORMATION. The City of Farmington Hills is the only owner of record. Title is Municipal “A”.
Default. Default shall include (1) failure to observe these terms and conditions; (2) failure to make good and timely payment; or (3) failure to remove all assets within the specified time. Default may result in termination of the contract and suspension from participation in all future sales until the default has been cured. If the Buyer fails in the performance of their obligations, Seller may exercise such rights and may pursue such remedies as are provided by law. Seller reserves the right to reclaim and resell all items not removed by the specified removal date.
Acceptance of Terms and Conditions. By submitting a bid, the bidder agrees they have read, fully understand and accept these Terms and Conditions, and agree to pay for and remove the property, by the dates and times specified. These Terms and Conditions are displayed at the top of each page of each asset listed on GovDeals. Special Instructions appearing on the asset page will override certain sections of the terms and conditions.
TAX: All tax issues will be handled by the awarded bidders Secretary of State.
Sales to Employees. Employees of the Seller may bid on the property listed for auction, so long as they do NOT bid while on duty.
