Online Sales - Terms and Conditions
All bidders and other participants of this service agree they have read and fully understand these terms and agree to be bound thereby.
NOTICE is hereby given by the Montgomery County Tax Claim Bureau, in and for the COUNTY OF MONTGOMERY under Sections 601-609 inclusive of the Real Estate Tax Law of 1947, as amended, that the BUREAU will expose at a public sale that will be held virtually commencing at 8:30 A. M. on September 18, 2025 for the purpose of collecting unpaid 2023 and or ANY PRIOR REAL ESTATE TAXES, PRIOR LIENS, MUNICIPAL CLAIMS, and all costs hereto, the following described set forth.
In every case the TAX CLAIM BUREAU is selling the TAXABLE INTEREST, and the property is offered for sale by the TAX CLAIM BUREAU without guarantee or warranty whatever, either as to structure or lack of structure upon the land, the Liens, Title or any other matter of thing whatever. Montgomery County Tax Claim Bureau in accordance with the statue provided Notice to the record owner. Lien holders were not notified, and all properties are being sold subject to any existing liens.
Bidder Qualification: In accordance with Act No. 133 and Act No. 33, prospective purchasers at all tax sales are now required to certify as follows:
1. Prospective bidders shall be required to provide certification they are not delinquent in paying real estate taxes to any taxing district in this Commonwealth and that the applicant has no municipal utility bills, as defined in section 619.1(b), that are not more than one (1) year outstanding anywhere in this Commonwealth.
2. Prospective bidders shall be required to provide certification they are not bidding for or acting as an agent for a person who is barred from participating in the sale under section 601(d).
3. Prospective bidders shall be required to provide certification they have not within the three (3) years preceding the filing of the application, engaged in a course of conduct or permitted an uncorrected housing code violation, as defined in section 619(e), to continue unabated after being convicted of an uncorrected housing code violation, as defined in section 619(e), and has not either:
a. Failed to maintain property owned by the application in a reasonable manner such that the property posed a threat to health, safety or property; or
b. Permitted the use of property in an unsafe, illegal or unsanitary manner such that the property posed a threat to health, safety or property
4. Prospective bidders understand that an applicant who signs a bidder registration application knowing that it contains a false statement and who causes it to be filed with the bureau shall be subject to prosecution for the commission of a misdemeanor of the second degree in violation of 18 Pa. C.S. § 4904(a) (relating to unsworn falsification to authorities).
5. Prospective bidders must be registered in person no later than 4:00 PM on September 5th. No registration will be taken after said date. Registration and certification forms are available at www.montgomerycountypa.gov/taxclaim.
6. Pursuant to Section 601(d) of the real Estate Tax Sale Law, 75 P.S. Section 5860.601(d), prospective bidders may not have had a landlord license revoked in any municipality within the County of Montgomery, and that they are not bidding for or acting as an agent for a person whose landlord license had been revoked.
7. If a successful bidder should tender a bad check, said bidder shall not be permitted to bid on any properties in future sales and will be referred to the Montgomery County District Attorney’s Office for prosecution.
8. Payment by the winning bidder is due in the form of a CASHIER’S CHECK OR WIRE TRANSFER NO LATER THAN 4:30 PM ON THE DAY OF THE SALE.
9. Prospective Bidders or their authorized agent(s), as described in Paragraph 10, MUST APPEAR TO REGISTER IN-PERSON. Mailed-in registrations WILL NOT BE ACCEPTED AND WILL BE REJECTED AND RETURNED ON THIS BASIS.
10. If the Applicant is not an individual, documentation must be provided showing that the signor of the registration packet has the authority to act on behalf of the applicant, and the individual appearing in person to register as required under Section 502-A(5) of the Real Estate Tax Sale Law, is the signor of the application or otherwise is authorized to act on behalf of the applicant.

** The successful bidder is also certifying that they are not the owner of the property as the owner has no right to purchase his own property. A change of name or business status shall not defeat the purpose of this section. For the purpose of this section, “owner” means any individual, partner, shareholder, trust, partnership, limited partnership, corporation or another business association that has any individual as part of the business association who had any ownership interest or rights in the property.
Guaranty Waiver. All assets are offered for sale “AS IS, WHERE IS.” Montgomery County Tax Claim Bureau (Seller) makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. The Buyer is not entitled to any payment for loss of profit or any other money damages – special, direct, indirect or consequential. IT IS STRONGLY URGED that prospective purchasers have an examination made of the title to any property in which they may be interested.
Consideration of Bid: Seller reserves the right to reject any and all bids and to withdraw from sale any of the assets listed at any time until the Seller has received payment in full. The actual sale occurs when payment of the full amount of money agreed to be paid as the sale price is received from the successful bidder or purchaser at the sale.
Post-Sale Set Asides: Absent a Court Order, the Tax Claim Bureau will not voluntarily agree to set aside sales after the Tax Claim Bureau deed is recorded and transfer taxes paid. As such, if you seek to cancel a sale your stipulation must be received by our Solicitor before the Deed is recorded.
Buyer’s Certificate: If applicable, successful bidders will receive a Buyer’s
Certificate by email from GovDeals as their notice of award.
Buyer’s Premium & Additional Fees: If a Buyer’s Premium and/or Additional Fees are shown on the auction page Bid Box, then that amount (expressed as a percentage of the final selling price or a specified amount) will be added to the final selling price of all items in addition to any taxes imposed.
Transfer Tax and Deed Recording Fee. Buyers shall be subject to payment of Real Estate Transfer Tax and Deed Recording Fees. Please review the Payment Instructions for all information related Transfer Tax and Deed Recording Fees.
Payment: Payment in full is due no later than 4:30 PM on Thursday September 18, 2025. Please refer to the payment instructions listed on the auction page for complete payment terms and methods. Please refer to the Bid Box for all fees and taxes that may be associated with the auction.
Default. Default shall include (1) failure to observe these terms and conditions; or (2) failure to make good and timely payment. A successful bidder shall not tender a bad check to the Tax Claim Bureau when purchasing property in the sale. If this should occur that bidder shall not be permitted to bid on any properties in future sales and will be referred to the Montgomery County District Attorney’s Office for prosecution under Pennsylvania Crimes Codes, 18 Pa. C.S.A. §4105 which may lead to a CONVICTION OF A FELONY OF THE THIRD DEGREE.
Acceptance of Terms and Conditions. By submitting a bid, the bidder agrees they have read, fully understand and accept these Terms and Conditions, and agree to pay for and remove the property, by the dates and times specified. These Terms and Conditions are available for review in the bid box at the top of each page of each asset listed on GovDeals. Specific Instructions (Payment, Removal, and Special) appearing on the asset page will override certain sections of these Terms and Conditions.
Sales to Employees. Employees of the Montgomery County Tax Claim Bureau may not bid on the property listed for auction.
Non-Discrimination: The County of Montgomery does not discriminate on the basis of race, color, national origin, sex, religion, age, disability or familial status in employment or the provision of services.
