Incorporation by Reference of User Agreement. These User Agreement are specific to this auction and supplement our standard User Agreement applicable to all bidders on our marketplace. You hereby acknowledge and agree to the most recent User Agreement which are hereby incorporated by reference into these Terms and Conditions specific to this auction. In the event of a conflict between these Terms and Conditions specific to this auction and our standard User Agreement, these Terms and Conditions shall control. A link to our most current version of User Agreement can be found at the bottom of the page and on the Site Map which can be accessed at the bottom of each page on our marketplace website

GUARANTY WAIVER AND DISCLAIMERS: All property is offered for sale “AS IS, WHERE IS.” All sales are final. NO REFUNDS. Seller makes no warranty, guaranty, or representation of any kind, including drivability or roadworthiness of vehicles. All known information is provided. Items not explicitly included in the description, such as background items, are not included. We offer no guarantee on the condition, completeness, or functionality of any components and/or parts of any asset and do not test or verify their integrity. Vehicles may be missing catalytic converters and other components. There could also be dirt, stains, mold-like substances, odor, rust, dents, dings, and scratches. This is not intended as a comprehensive list. There could be other unknown issues. Pictures may not be wholly representative of the exact asset(s) you'll receive. Asset condition accurate at time of listing. Asset condition subject to change. The Buyer is not entitled to any payment for loss of profit or any other monetary damages of any form.


Personal and property risk
:  Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the seller and GovDeals from liability therefore.

Inspection: Please inspect items prior to placing a bid. Inspections are by appointment only. Inspections do not include a test drive. See Asset Contact under Seller Information for phone and email. Most items offered for sale are used and may contain defects not immediately detectable. Bidders may inspect the property prior to bidding. Inspections not available to anyone (including the winning bidder) after the auction ends.


Consideration of Bid: Seller reserves the right to reject any and all bids, and to withdraw from sale any of the assets listed at any time and without notice.

Buyer’s Certificate:  Successful bidders will receive a Buyer’s Certificate by email from GovDeals.


Buyer’s Premium: If a Buyer’s Premium is shown on the auction page bidder box, then that amount (expressed as a percentage of the final selling price) will be added to the final selling price of all items in addition to any taxes imposed.


PAYMENT:

If you are the winning bidder, you will facilitate payment by referring to the My Bids section of your account.

Note:

1. Payment is due within 5 (five) days of auction closure.

2. Any invoice $5,000 or above requires payment via wire transfer.

3. Depending on your history with GovDeals, you may be limited to the number of auctions/transactions that you can participate in simultaneously AND/OR the dollar amount that you can pay via credit card, debit card or PayPal. For additional insight, please visit the Probation FAQ.

SALES TAX

When applicable, sales tax is calculated based upon the auction’s advertised location.

If you are seeking sales tax exemption, you must complete Liquidity Services’ tax exemption form(s). We recommend doing this prior to the auction’s closure or before making payment. To do so, please visit Liquidity Services' Tax Exemption Submission Tool.

 


***Please Note: After the winning bidder's payment has cleared GovDeals, the winning bidder will be sent an email from the Division of Surplus Property (DSP). The email will include a paid Bill of Sale. The document will require the signature of the winning bidder. Please make sure your email, physical address, and phone number are all up to date within the Govdeals system. Failure to maintain current contact information of any form can result in penalties.


Removal
:

1.The winning bidder will receive a copy of the BILL OF SALE from DSP personnel (not the Buyer's Certificate from GovDeals) via email to the email address on file with GovDeals.

2.The winning bidder will fill out and sign the Bill of Sale, and email it back to DSP. 

3. IF SHIPPING IS AVAILABLE FOR THIS ASSET: To ship, the winning bidder must provide a USPS Flat Rate Label for an appropriately sized Flat Rate Priority Box. Please contact us to select the appropriate packaging. We do not use envelopes. We reserve the right to deny shipping if these conditions are not met.

Any special instructions will be noted in the assets description.

All items must be removed within a maximum of ten (10) days from the closure of the auction, which consists of five (5) days to pay, and five (5) days to pick up after payment is made. Purchases will be released only upon receipt of payment as specified. Successful bidders are responsible for loading and removal of any and all property awarded to them.

A daily storage fee may be charged, or other penalties (at our discretion) may be applied for any item not removed within the ten (10) days allowed, as stated above.

IF YOU WILL NOT BE PRESENT FOR PICK UP AND SEND A 3RD PARTY, YOU WILL NEED TO EMAIL US A COMPLETE AUTHORIZATION OF RELEASE FORM, WHEN YOU MAKE AN APPOINTMENT. Your 3rd Party should NOT arrive without an appointment. ID verification is required upon removal of the asset.

Default:  Default shall include (1) failure to observe these terms and conditions; (2) failure to make good and timely payment; or (3) failure to remove all assets within the specified time.  Default may result in termination of the contract and suspension from participation in all future sales until the default has been cured.  If the Buyer fails in the performance of their obligations, Seller may exercise such rights and may pursue such remedies as are provided by law.  Seller reserves the right to reclaim and resell all items not removed by the specified removal date.



Acceptance of Terms and Conditions:  By submitting a bid, the bidder agrees they have read, fully understand and accept these Terms and Conditions, and agree to pay for and remove the property, by the dates and times specified. These Terms and Conditions are displayed at the top of each page of each asset listed on GovDeals. Special Instructions appearing on the asset page will override certain sections of the terms and conditions.


State/Local Sales and/or Use Tax
:  Buyers may be subject to payment of State and/or local sales and/or use tax. Buyers are responsible for contacting seller or the appropriate tax office, completing any forms and paying any taxes that may be imposed.


Sales to Employees:  Employees of the Seller may bid on the property listed for auction, so long as they do NOT bid while on duty.
