Inspection

Most items offered for sale are used and come from all over the City. The conditions of the items may contain defects not immediately detectable. Buyers are invited and strongly encouraged to physically inspect the offered items prior to bidding. Inspections for sale items are by APPOINTMENT ONLY. Vehicles are located in a secure area with no public access. Bidders must adhere to the inspection dates and times. Payment

PAYMENT MUST BE MADE ONLINE-- To make online payment, Log into your GovDeals account and select “My Bids”. Please follow the instructions there. Payment in full is due not later than five (5) business days from the time and date of the close of the auction. Payment must be made electronically through the GovDeals Website. Payment Methods are listed above. TAX CALCULATION & EXEMPTIONS--TAX CALCULATION: Sale Tax, where applicable, will be calculated and added at the end of the auction. TAX EXEMPTION: Where taxes are applicable (see the Buyer’s Certificate), Tax Exempt documents must be provided to GovDeals Bidder Services at tax@govdeals.com within 24 hours of the auctions close and before payment is made. Bidders are encouraged to submit their Tax Exempt Documentation prior to the Auction’s close to expedite this process. Please contact GovDeals Bidder Services for all tax exemption questions.



Removal

Property may be removed by appointment only and appointments must be made at least 24 hours in advance. All items must be removed within ten (10) business days from the time and date of the close of the auction. The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. No Assistance will be provided. NO TOOLS ARE AVAILABLE FOR PUBLIC USE AND NO MECHANICS ON SITE! Winning Bidder must come prepared to push, pull, haul, tow, or whatever means necessary for the removal of purchased item. Property may be removed between the hours of 8:00 am and 3:00 pm Monday through Friday, excluding legal holidays. Titles will be mailed to the Winning Bidder after item has been paid for and picked up.
Items not removed within ten (10) days of the issuance of the Buyer’s Certificate will be considered abandoned/forfeited, buyer is declared default, and ownership shall revert to the City of Sumter (Seller). Bidders will be locked unless a prior arrangement has been made for any item not removed within the ten (10) business days allowed and stated on the Buyer's Certificate.

NOTICE: If you are the winning bidder and default by failing to adhere to this Seller’s terms and conditions your account with Liquidity Services WILL BE LOCKED.
Guaranty Waiver: All property is offered for sale “AS IS – WHERE IS.” The City of Sumter (Seller) makes no warranty, guaranty, or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the items offered. The Buyer is not entitled to any payment for loss of profit or any other damages – special, direct, indirect, punitive, or consequential. Please note that upon removal of the property, all sales are final. No Refunds. No Exchanges.
Titles will be mailed to the Winning Bidder after the item has been paid for and picked up.
Bidder represents and warrants it shall indemnify and hold the City of Sumter harmless from any liability, damage, expense, claims, liens or judgements, including reasonable attorneys’ fees, resulting from injury to person or damage to property resulting from or in any fashion arising out of the Bidder’s inspection of the item including but not limited to the negligent acts, errors, or omissions of Bidder, its agents, employees, volunteers, contractors, or invitees. Bidder understands and agrees that the item is being sold in “AS-IS” condition without any representation regarding the item’s condition or otherwise.
Waiver of all liability from the City of Sumter (Seller) for loading and property removal. The winning bidder will be liable for any damage or harm that may take place during the loading and removal of an item awarded to the bidder. In addition, the winning bidder shall indemnify, defend, and save harmless the City of Sumter and their representatives from any liability arising out of the winning bidder’s acts or omissions including failure to secure adequate insurance coverage.
