BID AT YOUR OWN RISK. The asset is offered for sale "AS IS, WHERE IS" and may contain defects. Board of Education of Washington County, MD, makes no warranty, guarantee or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the asset offered for sale. Assets offered for sale are used and may contain defects not immediately detectable.

Payment

Pricing/Payment

a.       No Pricing will be submitted in the hard copy submission.  The prices of the units will be determined by the GovDeals Auction.

b.       The vendor that wins the auction shall pay govdeals.com in full, including any applicable fees and/or taxes prior to scheduling device pickup with WCPS.

c.       If any of the device counts are off from the stated amount on this Bid document.  The winning unit price submitted during the auction times the number of miscounted devices will be paid to WCPS (device count is higher) or credited by WCPS to the vendor (device count is lower).

d.       PAYMENT IN FULL IS DUE WITHIN FIFTEEN (15) BUSINESS DAYS FROM THE TIME AND DATE OF THE BUYER'S CERTIFICATE.  PAYMENT MUST BE MADE ELECTRONICALLY THROUGH THE GOVDEALS WEBSITE BY LOGGING IN TO YOUR GOVDEALS ACCOUNT AND SELECTING “MY BIDS”.

PAYMENT

If you are the winning bidder, you will facilitate payment by referring to the My Bids section of your account.

Note:

1. Payment is due within15 (fifteen) business days of auction closure.

2. Any invoice $5,000 or above requires payment via wire transfer.

SALES TAX

When applicable, sales tax is calculated based upon the auction’s advertised location.

Removal

Device Pickup

a.       No assistance will be provided by the Seller to pack, ship, move, load, etc.

b.       Buyer is responsible for making all logistic and physical preparations necessary to remove the devices from Seller’s property.  

c.       Buyer is responsible for making an appointment to pick up the devices at least 48 hours in advance by calling 301-766-8820 or emailing (ITAM@wcps.k12.md.us) .

d.       Buyer is responsible for notifying Seller if NOT picking up assets in person.  Please email (ITAM@wcps.k12.md.us) the name and phone number of the person picking up the assets on your behalf.

e.       Person picking up on your behalf must possess a government-issued photo ID to present to Seller as proof of identity.  Buyer is responsible for removing assets from Seller’s property at the time he/she signs the Bill of Sale.

f.        The Buyer is responsible for bringing a vehicle large enough to haul devices.

g.       The Buyer is responsible for bringing the appropriate equipment needed to move and load the devices.

h.       The Buyer is responsible for bringing enough personnel to assist with moving and loading the devices.

GUARANTY WAIVER: All assets offered for sale “AS IS, WHERE IS.” Seller makes no warranty, guaranty or
representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the asset offered for sale.
The Buyer is not entitled to any payment for loss of profit or any other money damages – special, direct, indirect, or consequential.

DESCRIPTION WARRANTY: Seller warrants to the Buyer that the asset offered for sale will conform to its description. Any claim for asset(s) inconsistency must be made PRIOR to removal of the asset. If Seller confirms that the asset does not conform to the description, Seller will keep the asset and refund “Actual Sold Amount” – “Buyer’s Premium” amount is excluded from refund. The liability of Seller shall not exceed the actual purchase price of the asset.
PLEASE NOTE THAT UPON REMOVAL OF THE ASSET, ALL SALES ARE FINAL.
