Inspection: Most items offered for sale are used and may contain defects not immediately detectable. Bidders may inspect the property prior to bidding by contacting: Scott Lawler or Ricky Gibbs by phone at (770) 794-5660. Office hours are 7AM - 3:30PM EST, closed for lunch 12PM - 1PM Inspection privileges will only be granted to those who have scheduled an appointment . WALK-UPS WILL NOT BE ACCEPTED!

PAYMENT

If you are the winning bidder, you will facilitate payment by referring to the My Bids section of your account.

Note:

1. Payment is due within 5 (five) business days of auction closure.

2. Any invoice $5,000 or above requires payment via wire transfer.

SALES TAX

When applicable, sales tax is calculated based upon the auction’s advertised location.

If you are seeking sales tax exemption, you must complete Liquidity Services’ tax exemption form(s). We recommend doing this prior to the auction’s closure or before making payment. To do so, please visit Liquidity Services' Tax Exemption Submission Tool.

Removal

All items must be removed within 10 business days from the time and date of issuance of the Buyer’s Certificate. The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property and be responsible for arranging all shipments for the award.



No Assistance will be provided. ITEMS AUCTIONED ARE FOR PICKUP ONLY. PACKAGING AND SHIPPING ARE THE SOLE RESPONSIBILITY OF THE BIDDER. NO EXCEPTIONS WILL BE CONSIDERED.

We DO NOT accept prepaid shipping labels, nor will we place any auction items in a box or package on your behalf.



The seller will not be responsible for any shipping, delivery, taxes or other charges.

*** If using a third-party courier service, notarized authorization must be made ahead of time and accompany third party in order for auction item to be picked up on your behalf; then the third party may arrange shipment on your behalf.

**Person removing asset must provide copy of Buyers Certificate, notarized authorization and photo identification at time of removal. The Buyer’s Certificate serves as Proof-of-Purchase and must be presented at the time of item removal.**



Property may be removed by scheduled appointment only. Walk-Ups are not acceptable! Pick up times are 9AM-11AM and 1PM-3:00PM EST. All pickups will be scheduled Monday to Friday during business hours. No weekend pickups are available.

Asset(s) may not be located at address listed, please confirm location with seller.

A daily storage fee of $10.00 may be charged for any item not removed within 10 business days allowed and stated on the Buyer’s Certificate.



*** Default shall include (1) failure to observe these terms and conditions (2) failure to make good and timely payment; or (3) failure to remove all items within the specified time. Default may result in termination of the contract and suspension from participation in all future sales until the default has been cured. If the Buyer fails in the performance of their obligations, Seller may exercise such rights and may pursue such remedies as are provided by law. Seller reserves the right to reclaim and resell all items not removed by Buyer. ***

Special instructions Guaranty Waiver. All property is offered for sale “AS IS, WHERE IS.” The City of Marietta (Seller) makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. The Buyer is not entitled to any payment for loss of profit or any other money damages – special, direct, indirect, or consequential. Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim or “mis-description” MUST be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of City of Marietta shall not exceed the actual purchase price of the property. Please note that upon removal of the property, All SALES ARE FINAL. All vehicles are subject to Buyer’s responsibility to ensure vehicle is in conformance to the requirements of local and state traffic laws.
