NCTD will not provide any employees or equipment to aid in the loading of the Vehicle. The buyer is solely responsible for determining the method and means of transportation needed to transport the Vehicle and NCTD should be held harmless from, and all liability arising from or connected with the hauling, towing, driving, flatbed trailer, or any other means of transportation. The Buyer takes ownership and all related responsibility of the Vehicle upon removal from NCTD’s Facility and NCTD shall be fully relieved of any liability related to the use, access, or transport of the Vehicle. Vehicles are sold “as-is” and NCTD makes no representations or express and/or implied warranties of any kind, including as to the condition or performance of the Vehicle. The buyer will defend, indemnify and hold NCTD, its Board of Directors, officers, employees, consultants, contractors and agents harmless from any and all liability, loss, expense (including reasonable attorneys’ fees and other defense costs), demands, suits, liens, damages, costs, claims, including but not limited to, claims for bodily injury, death, personal injury, or property damage arising from or connected with this auction.
