1. Payment is due within 5 (five) business days of auction closure.

2. Any invoice $5,000 or above requires payment via wire transfer.

SALES TAX

When applicable, sales tax is calculated based upon the auction’s advertised location.

Removal

All items must be removed within 10 business days (by 4:00 p.m.) from the date of issuance of the Buyer’s Certificate or the buyer will be defaulted. If the buyer is defaulted, GovDeals will refund the purchase price plus any taxes. THE 5% BIDDER FEE IS NOT REFUNDABLE if you default. Purchases will be released only upon receipt of payment as specified. Successful bidders are responsible for loading and removal of any and all property awarded to them from the place where the property is located. The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. No Assistance will be provided. ITEMS AUCTIONED ARE FOR PICKUP ONLY. PACKAGING AND SHIPPING ARE THE SOLE RESPONSIBILITY OF THE BIDDER. NO EXCEPTIONS WILL BE CONSIDERED. A daily storage fee of $10.00 may be charged for any item not removed within the 10 business days allowed and stated on the Buyer’s Certificate. The Buyer’s Certificate serves as Proof-of-Purchase and must be presented at the time of item removal.** If using a 3rd-Party agent; Buyer must provide agent with a faxed copy including their signed authorization to release their items. Buyer must notify Seller if using a Third-Party Agent.
Anyone picking up an item must have the Buyer's Certificate in hand. After WVSASP receives confirmation that the buyer has paid, WVSASP will e-mail the buyer a copy of the Bill of Sale with instructions for removing the item. Items will not be released to anyone other than the winning bidder unless prior arrangements have been made with WVSASP. The prior arrangements must be e-mailed to the contact below from the e-mail address that is on file for the winning bidder.

All property is offered for sale “AS IS, WHERE IS.” The West Virginia State Agency for Surplus makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. Please note that upon removal of the property, all sales are final.
Description Warranty. Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for mis-description must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property.
