individual bicycles.

Brands in this batch include: Liv, Critical, Schwinn, Specialized, and more.

Pursuant to California Civil Code 2080.8
this batch of bicycles is being made available for public auction.



Disclaimer

This lot contains used and untested pieces of equipment which may contain defects not immediately detectable
or known
about. Having been disused for a long period of time, the bicycles may need significant repair and/or part(s)
replacement to be made functional. No guarantee of condition is provided, all property is sold as-
is
. Bidders are highly encouraged to inspect prior to bidding. See information below for viewing
availability.



All auctioned items are sold where-is. Winning bidders are responsible for removal of won
items. Hours of removal are Monday through Friday, 9AM to 4PM, excluding legal holidays and require
scheduling ahead of arrival. More information below.



Payment is required within five (5) business days of auction close.



Assumption of Liability: The purchaser shall assume all liability for the property after the award is made. UC
Davis will exercise its usual care for protection up to the time of removal, but will not be responsible for any loss
or damage. The bidder guarantees to indemnify UC Davis, its agents or employees, harmless from liability of any
nature or kind in the sale of or bidder's use of the property.

Rules of the Sale


All Items are sold As-Is and Where-Is and all sales are final. BATCH MUST BE REMOVED ALL AT ONCE, please bring an appropriate vehicle or trailer. No refunds are offered. There is no guarantee or
warranty by UC Davis Transportation Services as to condition or quality of property. UC Davis Transportation
Services reserves the right to withdraw, remove and revoke at any time any items being offered for any reason.

Inspection

Bidders may inspect the property prior to bidding.

Auction items are viewable by appointment only: 9:00 am - 4:00 pm MONDAY thru FRIDAY, excepting University Holidays and closures.

Payment

PAYMENT

If you are the winning bidder, you will facilitate payment by referring to the My Bids section of your account.

Note:

1. Payment is due within 5 (five) business days of auction closure.

2. Any invoice $5,000 or above requires payment via wire transfer.

3. Depending on your history with GovDeals, you may be limited to the number of auctions/transactions that you can participate in simultaneously AND/OR the dollar amount that you can pay via credit card, debit card or PayPal. For additional insight, please visit the Probation FAQ.

SALES TAX

When applicable, sales tax is calculated based upon the auction’s advertised location.

If you are seeking sales tax exemption, you must complete Liquidity Services’ tax exemption form(s). We recommend doing this prior to the auction’s closure or before making payment. To do so, please visit Liquidity Services' Tax Exemption Submission Tool.

Removal

No property may be removed by the purchaser prior to making full payment.

Property may be removed by appointment only and appointments must be made at least 24 hours in advance. All items must be removed within ten (10) business days from the time and date of issuance of the Buyer's Certificate.

The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. No Assistance will be provided. A daily storage fee of $10.00 may be charged for any item not removed within the 10 business days allowed and stated on the Buyer's Certificate.

A receipt will be signed by the bidder at the time property is picked up and any required identification or purchase information by law or policy must be provided.

No service of any kind will be furnished by UC Davis. The buyer shall assume any cost of weighing, packaging; crating, loading or hauling, shipping, insurance.

Applicable Law and Courts: Any contract resulting from this solicitation shall be governed in all respects by the laws of California and any litigation with respect thereto shall be in California. The contractor shall comply with applicable federal, state and local laws and regulations.

NOTICE: If you are the winning bidder and default by failing to adhere to this seller's terms and conditions your account with Liquidity Services WILL BE LOCKED.

Guaranty Waiver. All property is offered for sale 'AS IS, WHERE IS.' University of California - Davis, Transportation Services makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. Please note that upon removal of the property, all sales are final.

Description Warranty. Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property.

Diesel Trucks & Buses:
An on-road heavy-duty diesel or alternative-diesel vehicle operated in California may be subject to the California Air Resources Board Regulation to Reduce Particulate Matter and Criteria Pollutant Emissions from In-Use Heavy-Duty Diesel Vehicles. It, therefore, could be subject to exhaust retrofit or accelerated turnover requirements to reduce emissions of air pollutants. All Passenger Vehicles:
This agency does NOT provide SMOG CERTIFICATION or EMISSIONS RETROFIT. All smog related repairs and certifications for vehicles are the sole responsibility of the buyer as outlined in California Vehicle Code, Division 12, Section 24007.5.

Heavy Equipment:
TITLE 13 CALIFORNIA CODE DISCLOSURE OF REGULATION APPLICABILITY: WHEN OPERATED IN CALIFORNIA ANY OFF-ROAD DIESEL VEHICLE MAY BE SUBJECT TO THE CALIFORNIA AIR RESOURCES BOARD IN-USE OFF-ROAD DIESEL VEHICLE REGULATION. IT THEREFORE COULD BE SUBJECT TO RETROFIT OR ACCELERATED TURNOVER REQUIREMENTS TO REDUCE EMISSIONS OF AIR POLLUTANTS.
